Welcome to displaywell.com! Please take a few minutes to read these Terms and Conditions. Your purchase of products and services from us constitutes your agreement to follow these Terms and Conditions and to be bound by them.

Display Well reserves the right to update or modify these Terms and Conditions at any time without prior notice. For this reason we encourage you to review these Terms and Conditions whenever you purchase services or products from us or use our web site.

These Terms and Conditions govern your access and use of the DisplayWell.com website. By accessing or using the DisplayWell.com website you agree to be bound by these Terms and Conditions and to any additional guidelines, restrictions, or rules that may be posted in connection with specific sections or services of the DisplayWell.com website. All such additional posted guidelines, restrictions, or rules are hereby incorporated by reference into these Terms and Conditions.

As part of our service, we agree to provide you with information and other services that we may decide to offer, subject to the terms of this agreement. Upon notice published through the service, we may modify this agreement at any time. You agree and continue to agree to use our services in a manner consistent with all applicable laws and regulations and in accordance with the terms and conditions set out in the policies and guidelines outlined below. Please note that you will be referred to as 'customer' in this agreement. By using the service, you agree that you will not attempt to undermine the integrity of Display Well or the displaywell.com web site.

 

COPYRIGHT and TRADEMARK POLICY

All material and software Copyright (c) 2007 Display Well. All rights are reserved worldwide. It is strictly prohibited to re-distribute, copy or republish any of the material and software contained on the displaywell.com web site. All trademarks appearing on DisplayWell.com are trademarks of their respective owners.

TERMS OF SALE

By placing an order with Display Well or DisplayWell.com you are bound and agree to our Terms of Sale.

  • Online pricing and custom quotes are valid for 30 days and are subject to change without notice.
  • All quotes costs and estimates are considered tentative until we receive a completed order form and payment. Estimates may be revised and the customer will be notified.
  • Charges for delivery of materials and supplies from the client or client's supplier to Display Well are not included in quotations unless specified.
  • Normal Production time on standard orders is 5 - 8 business days after we receive proof approval. Rush requests are handled according to workload and priced accordingly.  This does not include shipping and delivery time.
  • The customer must examine the completed order and notify us of any discrepancies within 48 hours of receipt of order.
  • Display Well reserves the right to subcontract all or any portion of an order to an outside vendor.
  • Full payment is due before the order will be released for design and production.
  • Final invoices will be supplied via email. No hard copy will be sent.
  • We do not offer cash refunds.
  • Samples of your product may be used for sales or marketing purposes.
  • Your name may be included in our newsletter, website and promotional database.
  • Display Well does not sell or share any customer information with third parties.
  • All other industry trade customs will apply. If unfamiliar with these, ask us. In the event that any legal action is initiated, the venue shall be in the District of Columbia, subject to District of Columbia laws.

 

CUSTOMER CONTENT INFORMATION

You understand that all information, data, text, photographs, graphics, artwork, images messages or other materials ("Content") are the sole responsibility of the person from which such Content originated. This means that you, and not DisplayWell.com, are entirely responsible for all Content that you send, upload, post or otherwise transmit via the Service. Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content. You agree to not use the Service to send, upload, post or otherwise transmit any Content that contains (i) child pornography or anything indecent, obscene, lewd, lascivious, filthy or vile; (ii) a threat to kidnap or injure a person, a threat to injure the personal property or reputation of another person, a threat to accuse any person of a crime, a threat to inform another that a person has violated any law of the United States, or a threat of blackmail; (iii) any matter advocating or urging treason, insurrection, or forcible resistance to any law of the United States; (iv) any defamatory remarks directed at any other person or company; or (v) any content that infringes the intellectual property rights or other proprietary rights of Display Well or any third party.

Display Well does not control the Content posted by Customers and does not guarantee the accuracy, integrity or quality of the Content. Under no circumstances will Display Well be liable to you in any way for any Content you may be exposed to that you may find offensive, indecent or objectionable.

You agree to abide by these terms of service and not to use these products and services or related messages for any unsolicited or unauthorized advertising, promotional materials, or any other form of solicitation.

You understand that you control the privacy of any Content you elect to post by granting access under your personal password. When you, or someone to whom you have given access, orders a print item using your password, you grant displaywell.com the world-wide, royalty free and non-exclusive license to use, reproduce, sublicense, modify, adapt, publish, display and create derivative works from the Content on the Service and on the printed product for the purposes of storing designs or processing print orders. This license exists only for the length of time necessary for DisplayWell.com to complete your order or until you delete the Content from the Service.

If You do not purchase design services from Display Well, Display Well will not and does not pre-screen Content that you provide for production on Display Well products.You acknowledge that you are solely responsible for providing the finished and final production-ready artwork to Display Well.If You do purchase design services from Display Well, which includes copyediting and graphic design, Display Well accepts limited responsibility for the Content as explained in the Corrections, Changes and Revisions section below.

Display Well and its designees shall have the right (but not the obligation) in their sole discretion to remove any Content that violates the terms of service or may otherwise be objectionable. You further acknowledge and agree that DisplayWell.com may preserve Content and may also disclose Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the terms of service; (c) respond to claims that the Content violates the rights of third-parties; or (d) protect the rights, property, or personal safety of DisplayWell.com, its users and the public.

Copyright and Trademark Materials

You are solely responsible for your use of Content in combination with any images, graphics, text or other materials you incorporate into your Products. You agree that you will not include any text, image, design, trademark, service mark, or any copyrighted work of any third party in your Products unless you have obtained the appropriate authorizations from the owners. You warrant that your Products do not infringe upon any rights of any third party, including copyright, trademark, right of publicity or privacy, and will not libel or defame any third party, and that you have all required rights or permissions necessary to incorporate third party material into your Products.

By placing an order on with Display Well, you warrant that you have all necessary permission, right and authority to place the order and you authorize Display Well to design, print and/or produce Products on your behalf.

By submitting artwork to Display Well, you guarantee that the printed matter is not copyrighted by any parties and copyright symbols have not been removed. Materials may or may not have a copyright symbol, but are still entitled to copyright protection. Be sure to know your sources before submitting your work for reproduction.

Furthermore, you agree to compensate Display Well for all actual costs, liabilities, attorney fees and any other expenses associated with the infringement action.

 

Customer Submitted Content:  Artwork, Copy and Graphics

Before submitting an order, please read our Frequently Asked Questions section to be sure that your digital file adheres to the proper guidelines. By following the guidelines we've outlined, you will be ensuring the quickest turnaround and maximum quality of your display production. Please keep in mind turnaround times when submitting a job. Time delays may occur if you do not follow the file guidelines outlined in our FAQ.

All artwork or designs and images should be provided in RGB format, preferably or CMYK as a second option.Display Well is not responsible for any color shift that occurs in conversions from CMYK to RGB color modes.

All artwork, designs and images must be provided in minimum of 200 dpi at full size and 300 dpi at half size.We accept both RGB and CMYK format, though RGB is preferred.Display Well is not responsible for images printed as fuzzy, distorted or pixilated due to customer provided artwork.

Corrections, Changes and Revisions

If customer pays to have Display Well design his/her display, Display Well will provide one edited version of the textual content the customer provides.Display Well guarantees the copy will be free of errors. If the customer makes additional edits to the content after Display Well has provided its edited version, the customer is responsible for the final content. After Display Well has provided edited copy to the customer, it can not and does not check any subsequent submissions by the customer for spelling, grammar, or any other errors. The design will be printed as it appears during the approval step. It is the sole responsibility of the customer to ensure that all materials submitted for printing are formatted correctly.  You accept full responsibility for the final content.

If customer pays to have Display Well design his/her display, in the base price, he/she will receive 1 graphic design, i.e. comp and 2 rounds of revisions per display design.Once the customer has finalized and approved the textual content, i.e. copy, Display Well will then apply the textual content to create the graphic design/art direction for the display.Typically, the customer will receive 1 revision after the presentation of the first design, and 1 revision after the second presentation.After the 3rd presentation, the design will be ready for your final approval.  If you would like additional rounds of revisions, you will be charged extra for each additional revision.

Printing errors attributed to the customer are not subject to free reprint. Customers may correct their issue and reprint the order at 100% of the cost for each reprinted item. Errors caused by Display Well will be reprinted and shipped free of charge.

If customer chooses to provide their own final and production-ready artwork for their display, corrections and new file submissions prior to printing are billable items and will be added to your invoice and charged accordingly. Corrections are billed at $50 per correction and include photo manipulation, color correction and resizing. Typographical errors are $5 each. If we are able to manipulate your files, we can make minor corrections for the fees stated above OR a new file can be submitted for a $50 fee.

Color Proofing & Matching

Display Well offers no guarantee of "match-print" or "match-product" color fidelity. Display Well cannot prevent slight color drift throughout an order. Display Well cannot calibrate the customers computer monitor and therefore does not guarantee that the color printed will match the preview as it appears on the customers monitor.

Therefore, Display Well is not liable for color matching or ink density on screen proofs approved by the customers. Screen proofs will predict design layout, text accuracy, image proportion and placement, but not color or density.

Display Well will try it's best to match the gradient density of each color in a duo-tone, Display Well is not liable for the final appearance of a duo-tone unless the customer orders a color match proof for that order, which is an additional fee charged separately.

Application of lamination may effect or change the appearance of the printed colors. Display Well is not liable for the final color appearance of a laminated product/s.

 

ORDER AND PAYMENT INFORMATION

 

Order Approval

Customer is fully responsible for final emailed proof and layout approval prior to the printing process. Display Well is NOT LIABLE for errors in a final product caused by any of the following reasons:

· Misspelling Errors

· Punctuation Errors

· Grammar Errors

· Graphics Orientation or Placement

· Incorrect Fonts Usage

 

Order Cancellation

Display Well will be happy to help you cancel your order prior to designing, production and shipping.This means you order must be cancelled before it goes to our design department. To be eligible for cancellation, you must notify Display Well via email or phone, immediately upon receipt of your email confirmation that verified your order to intercept the design process. However, if your ordered product is already in the process of being designed or is en route or already delivered, we are unable to cancel your order.   

Display Well does not refund, cancel or credit if the service failure is caused, in whole or in part, by: Acts of God, weather conditions, environmental or dangerous goods incidents, perils of the air, public enemies, public authorities acting with actual or apparent authority, acts or omissions of customs officials, authority of law, quarantine, riots, strikes, work stoppages or slowdowns, or other labor disputes or disturbances, civil commotions or hazards incident to a state of war, local or national disruptions in ground or air transportation networks or systems due to events beyond our control, disruption or failure of communication and information systems, disruption or failure of utilities, or other circumstances beyond our control.


Returns and Refunds

Since each order is unique and has no re-sale value, All Sales Are Final. No refunds or credits are available on orders unless they are canceled before the design process begins. Every item we sell is carefully inspected before it is shipped.  If merchandise is defective or damaged upon receipt all claims MUST be made within 48 hours of receipt of your order. Please contact us by phone or email within 48 hours after your package arrives for a return authorization claim number. If no claim is received, both parties agree that the order has been accepted and Display Well has satisfied all terms, conditions and order requirements.

Should your display contain manufacturing errors and/or defects, we will reproduce and ship the exact display delivery terms at no charge. In order to receive a replacement Customer must return 99% of the received product within 10 days (on their own expense) from the time when the ordered product delivery was taken. Shipping charges will not be refunded.  DisplayWell.com reserves the exclusive right to judge what a manufacturing error and defect is. If we verify that we made an error, we will re-produce your order.

All charges related to expedite printing (Rush Printing or Shipping) are NOT REFUNDABLE, including for those orders that are returned for any reason. No Exceptions.

Payment Methods

We accept online payments using MasterCard, Visa, American Express, Discover and Pay pal. We also accept Money Orders and Cashier’s Checks. Please email service@displaywell.com if you’d like to mail a money order or cashier’s check. We are unable to accept COD orders, Personal or Business Checks. Full payment including shipping is due before the order will be released to design and production.

 

SHIPPING AND DELIVERY INFORMATION

Shipping Services and Terms

 

Display Well will always act to make sure that any production difficulties do not delay delivery schedules. In no case shall Display Well be liable for any consequential or damages resulting from any delay in shipment or delivery.

All Display Well customers agree not to hold Display Well liable for delays in shipments caused by weather conditions, shipping company delays, international customs issues or any other circumstances beyond Display Well's direct control. Display Well shipment and delivery dates are calculated based upon estimates provided by our suppliers and recent order history.

Display Well will always act to make sure that delivery schedules are met. However, unexpected equipment failure, malfunction and or technical problems may delay the printing process. In case of delay caused by technical difficulty, rush charges/fees will be refunded or waived where applicable. However, technical difficulty will not be the grounds for order cancellation.

 

Shipping Restrictions and Special Circumstances

We are happy to ship Display Well products to you anywhere around the world. Our online shipping prices are valid within the continental United States. For Alaska, Hawaii, US territories such as Puerto Rico and the Virgin Islands and International locations, please email our customer service department at service@displaywell.com.Provide us your exact shipping address and we will let you know what the shipping costs will be.   If you place your order online, select the appropriate drop-down option under “Shipping Location” on the Order Summary page and we will contact you to provide the shipping costs and continue the checkout process over the phone.

Please note there may be some restrictions in shipping to some countries. Products shipped outside of the United States may be charged a duty based on the receiving country's import tax. Display Well is not responsible for the payment of this fee. APO/FPO orders are shipped via standard delivery only. Heavy and oversized products can not be shipped to APO/FPO addresses.

We can ship your order to more than one address.  A separate order will be created for each shipping address you specify, and a per-shipment fee will be charged for each item. If you would like to ship to multiple address, email our customer service department at service@displaywell.com.Provide us your exact shipping addresses for each product and we will let you know what the shipping costs will be.   If you place your order online, Select “Multiple Locations” from the drop-down option under “Shipping Location” on the Order Summary page and we will contact you to provide the shipping costs and continue the checkout process over the phone.

 

Turnaround Timelines

The average production and inspection time for each display is 5-7 business days from the time the final design has been approved by the customer. Shipping times begin immediately upon finished production. Please add 5-7 business days to any shipping estimate to allow for production.

Although the majority of our orders are shipped within 5-7 business days after approval, turnaround times are not guaranteed. Your expected delivery date may change due to unforeseen delays, such as equipment failure, illness or late delivery by a carrier. Weekends and holidays are not included in your quoted turnaround time calculations.

Estimated Shipping Dates

We do our best to accurately estimate when items will ship from our facilities. Estimated shipping dates are based on several factors, including your destination address, how quickly we can obtain and assemble items for shipment, and whether you have requested that we ship to multiple locations.

Our estimated shipping dates are always a range of dates. It's entirely possible for an item that hasn't shipped by the beginning of the date range to still arrive within our stated delivery estimate.

Display Well may ship its products from various locations across the United States. Please be advised that your products may be shipped from any of these locations. If a product needs to reach you by a specific date, please select a shipping method other than Standard; otherwise your product may be delayed.

Estimated Delivery Dates

To determine the date you'll receive your order, use the following calculation:

(Proof Approval Date) + (5 Days for Production Days) + (2 Days for Inspection and Handling) + (Shipping Method*) = Estimated Delivery Date

*Shipping Method is defined as Standard Delivery, Express Delivery or Overnight Delivery.

Please note: there is no weekend delivery or pickup service for our Overnight and Express Delivery options.

Shipping Methods

Our normal shipping method is USPS ground. Rates are available for Postal (Standard), Priority (Express) and Overnight within the continental US. Shipments to more than one address may require additional shipping and handling charges for each location.

Display Well does not guarantee the turnaround times above on basic ground shipping. Delays on orders placed with ground shipping may occur. Display Well makes no guarantee about time in transit of any shipping methods.

Display Well is not responsible for delays and/or damage incurred during shipping. Insurance is included in your purchase for the value of your order. Shipments are sent “signature required” at your destination. If you elect “no signature required”, your right to all claims for damaged or missing product is void. Display Well must be notified within 48 hours of scheduled delivery if any shipments were not received on time, as stated by the carrier.

Display Well offers following shipping options when placing an order.

 

  • Standard Delivery takes 7-10 business days. Shipping time is NOT GUARANTEED.
  • Express Delivery takes 2-3 business days.
  • Overnight Delivery takes 1 business day.

 

Incomplete Partial Orders/Split Shipments

We may have to ship the ordered quantity partially due to production process error and in that case, balance of the order will be sent later.  Some times your order may be shipped from multiple locations.  In these cases your order may not all be delivered at the same time, please allow a few days from the date you expect your order to arrive for your complete order to be delivered.

 

Shipping Errors & Lost Packages

Lost or damaged claims can only be filed for shipments over $50.00 in value and can only be done after 30 days from package shipment. Display Well is not responsible for 3rd party shipping errors, omissions or damaged shipments.

A shipping claim may be initiated by Display Well. The results of that claim cannot be controlled and is not guaranteed. Title for finished work passes to the customer upon delivery to the carrier at shipping point or upon email of the invoice for the completed work or its segments, whichever comes first.


Customer Supplied Incorrect Address Information

When a package is not delivered due to an error made by the customer in submitting the proper shipping address, Display Well will reship the package with corrected address and charge an additional shipping fee for the shipment.

INDEMNITY

You agree to indemnify and hold DisplayWell.com, and its subsidiaries, affiliates, officers, agents, co-branders, print vendors, business partners, employees, successors or assigns harmless from any and all manner of claims, demands, actions and proceeding including all loss, cost expense, damages and  reasonable attorneys' fees, that may be instituted against Display Well made by any third party due to or arising out of Content you submit, post to or transmit through the Service, your use of the Service, your connection to the Service, your violation of the terms of service, or your violation of the rights of a third party.

DISCLAIMER OF WARRANTY

The site and its content are provided “as is” without warranty of any kind, either expresses or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement. You acknowledge that operation of the site may not be uninterrupted or error free. References and links to products or services of independent companies may appear on the site. These references and links are provided “as is” without warranty of any kind, either expressed or implied.


LIMITATION OF LIABILITY

In no event shall Display Well or its licensors, suppliers, or vendors, their officers, directors, employees, or agents be liable for any special incidental, indirect or consequential damages of any kind, or for any damages whatsoever resulting from loss of use, data, or profits, whether or not Display Well has been advised of the possibility of damage, arising out of or in connection with the use or performance of the site or of failure to provide services that you order from Display Well, DisplayWell.com or its affiliates, including without limitation, damages arising from mistake, omission, virus, delay, or interruption of service. In no event shall Display Well be liable or responsible for any damages or consequences arising from or related to our inappropriate or unauthorized use of this site or its content.
